BibleRay: AI Bible Chat

User Agreement

Applies to the iOS application BibleRay: AI Bible Chat.

1 Parties and acceptance

1.1

This User Agreement (“the Agreement”) sets the conditions on which the user may use BibleRay: AI Bible Chat for iOS (“the App”), provided by the company UBO OF MAGIT LLC DOO (hereinafter “the Company”).

1.2

A person who installs or opens the App accepts this Agreement. Anyone who does not accept it is not permitted to use the App.

1.3

The Agreement applies to every user wherever the user lives, including the United States and the countries of Latin America.

1.4

The App Store page of the App also refers to the standard Licensed Application End User License Agreement of Apple.

1.5

The general User Agreement of the Company applies only to questions this Agreement leaves open.

2 Licence

2.1

Provided the user complies with this Agreement, the Company grants the user a revocable, non-exclusive, non-transferable and non-sublicensable personal licence of limited scope to install the App and use it on a device the user owns or controls, for private, non-commercial purposes only.

2.2

The licence confers no rights to the source code of the App, to the technology behind it or to any intellectual property of the Company or its licensors.

3 Age

3.1

The App is intended for people aged 13 or older. By using it, the user confirms having reached that age.

3.2

A user who is 13 or older but has not reached the age of majority under local law may use the App only if a parent or legal guardian consents and accepts this Agreement on the user’s behalf.

3.3

Personal information of children below 13 is not collected knowingly. Information of this kind discovered by the Company is erased as the BibleRay Privacy Notice provides.

4 AI Chat

4.1

The App includes a chat driven by artificial intelligence that answers questions about the Bible (“AI Chat”). The user acknowledges that:

  • answers are generated by a machine and may contain mistakes, omissions or outdated or misleading statements;
  • answers are not advice of a professional nature — medical, legal, psychological, pastoral, theological or otherwise;
  • AI Chat is no substitute for reading Scripture oneself, for the counsel of qualified clergy or for consulting licensed professionals;
  • the user must judge whether an answer is correct, suitable and useful before relying on it;
  • the Company does not promise that answers follow the teaching of any specific denomination, doctrine or interpretation.
4.2

AI Chat must not be used to create hateful, defamatory, sexually explicit, harassing, abusive, harmful or unlawful material, or material infringing the rights of third parties.

4.3

Access to AI Chat may be restricted, suspended or withdrawn by the Company at any moment, with or without prior notice.

5 Bible texts and third-party content

5.1

The App lets the user read the Bible in several translations. The texts, together with material connected to them, come from API.Bible; their rights holders and licensors supply them.

5.2

Each translation and every other third-party material belongs to its owner and enjoys copyright and related protection. Using it is subject to the conditions set by the rights holder.

5.3

The Company does not answer for whether third-party content shown in the App is accurate, complete or available.

6 User Content

6.1

User Content is any question, prompt, message or other text the user submits in the App, AI Chat included.

6.2

User Content remains the property of the user. By submitting it, the user grants the Company a transferable, sublicensable, royalty-free, non-exclusive licence, valid worldwide, to store, host, reproduce, use, adapt, modify and process it for running, offering, developing and improving the App and each of its features, AI Chat among them.

6.3

The user warrants that:

  • the user owns the User Content or holds every right it requires;
  • the User Content respects this Agreement and the law;
  • the User Content does not violate rights of any third party.
6.4

The Company has the right, though no duty, to check, review or delete User Content at its own discretion.

7 Restrictions

7.1

The user shall not:

  • decompile, disassemble, copy, translate or reverse engineer the App, or attempt to obtain its source code;
  • embed the App in any other software;
  • use the App for commercial purposes;
  • create works derived from the App or modify it in any way;
  • sell on, rent out, lease, sublicense, assign, distribute or transfer in any other way the App or this licence;
  • overload, disable, damage or otherwise impair the App or the systems connected to it;
  • use the App against the law or against rights of third parties;
  • use the App or AI Chat to produce, send or spread obscene, hateful, defamatory, threatening, harassing, abusive, harmful, unlawful or otherwise objectionable content;
  • bypass access controls, security features or technical limitations of the App;
  • gather, scrape or harvest information about other users.
7.2

Any act carried out in breach of this Article has no legal effect.

8 Intellectual property

8.1

The software, interface, design, functions, branding and original content of the App remain exclusively owned by the Company or its licensors. Ownership of intellectual property in the App does not pass to the user.

8.2

Notices of copyright, trademarks or other rights of the Company must not be removed or concealed.

8.3

A person who believes that content in the App infringes a copyright held by that person may write to apps@magit.info, giving enough detail to locate the material concerned and contact details for a reply.

9 No warranty

9.1

The Company makes the App available “as is” and “as available”. No warranty of any kind — express, implied or statutory — is given, in particular as to title, accuracy, merchantability, non-infringement, fitness for a particular purpose or operation without interruptions or errors.

9.2

Nor is it warranted that the App will suit the needs of the user, run without faults or interruptions, or that every defect will be fixed.

9.3

This applies equally to the doctrinal correctness, reliability, completeness and accuracy of Bible translations, devotional texts and answers produced by AI.

10 Limitation of liability

10.1

Insofar as applicable law allows, neither the Company nor its affiliates, licensors, agents, employees or officers are liable for punitive, exemplary, special, consequential, incidental or indirect damages — among them lost profits, lost data, loss of goodwill and other intangible losses — that result from use of the App or from being unable to use it.

10.2

In any case, the aggregate liability of the Company under this Agreement or in connection with the App is capped at the higher of: (a) what the user paid the Company for the App during the 12 months before the event that caused the liability; (b) USD 10.

10.3

Where local law forbids excluding or limiting particular kinds of damages, the corresponding limitations above do not apply to the user.

11 Privacy

11.1

The BibleRay Privacy Notice, which forms part of this Agreement, explains the handling of personal data, chat conversations and technical logs included.

11.2

Using the App confirms that the user has read and understood that Notice.

12 Indemnity

12.1

Insofar as applicable law allows, the user shall indemnify the Company and its officers, employees, agents, licensors and affiliates, defend them and hold them harmless from any claim, loss, damage, liability or expense, reasonable legal fees included, resulting from:

  • misuse or any use of the App by the user;
  • the User Content of the user;
  • a breach of this Agreement by the user;
  • a breach by the user of any law or of rights of a third party.

13 Amendments

13.1

The Company may amend this Agreement at its discretion. Amendments are published in the App or on the App Store page of the App, with a new version date.

13.2

A user who does not accept an amendment must stop using the App; using it after the amendment takes effect means acceptance.

14 Subscriptions and payments

14.1

Certain functions are paid and need a subscription. Such subscriptions are sold solely via the Apple App Store; Apple’s conditions apply to them, among them the Apple Media Services Terms and Conditions.

14.2

Price, billing period and the length of a free trial, if one is offered, are shown in the App before the purchase. The amount is charged to the Apple ID of the user once the purchase is confirmed.

14.3

Renewal is automatic. Auto-renewal has to be switched off at least one full day (24 hours) ahead of the expiry of the running period; otherwise Apple bills the following period during the last day of the running one. Subscriptions are managed and cancelled under Settings / Apple ID / Subscriptions.

14.4

Apple handles every payment. A refund is requested from Apple at reportaproblem.apple.com, and the policies of Apple decide the outcome; the Company itself cannot refund App Store purchases.

14.5

Reading the Bible at the basic level and using the widgets cost nothing and require no subscription.

15 Termination

15.1

This Agreement remains in force until the user or the Company ends it.

15.2

The user ends it by deleting the App from the device and no longer using it.

15.3

The Company may suspend or end access to the App, with or without notice, where:

  • the user breaches this Agreement;
  • the law obliges the Company to do so;
  • the Company stops offering the App.
15.4

When the Agreement ends, the licence ends with it at once. Provisions intended by their nature to outlast termination continue to apply, in particular those on liability limits, indemnity, disclaimers, intellectual property and the resolution of disputes.

16 Governing law and disputes

16.1

This Agreement is governed by the law of the Republic of Serbia, where the Company is registered, without regard to rules on conflict of laws.

16.2

Any disagreement concerning this Agreement or the App is first to be discussed by the parties in good faith. Should no solution be found within 60 days, each party is free to use the remedies the applicable law provides.

16.3

Mandatory consumer protection rights granted by the country or state where the user lives remain unaffected.

17 General provisions

17.1

Complete agreement. Together with the BibleRay Privacy Notice, this Agreement is the complete arrangement between the user and the Company concerning the App and replaces any earlier arrangement on the subject.

17.2

Severability. Should a provision prove invalid or unenforceable, the other provisions stay fully effective.

17.3

Waiver. The Company does not give up a right or a provision by not exercising it.

17.4

Assignment. The user needs prior written consent of the Company to transfer or assign the Agreement; the Company may assign it freely.

17.5

Language. The Agreement is drawn up in English. If a translation departs from the English text, the English text governs.

17.6

Apple. The parties to this Agreement are the user and the Company; Apple is not a party. Responsibility for the App and its content lies with the Company, not with Apple. Apple, as a third-party beneficiary, has the right to enforce this Agreement against the user.
